Kirby Corporation ("Kirby") is committed to protecting your privacy. Your personal information will be used by Kirby for recruitment purposes. It will be protected internally according to the Kirby guidelines outlined below. By submitting your personal information you agree that Kirby may process it for recruitment purposes. Your consent to provide this information is required in order to obtain an application for employment.

Candidate Privacy Guidelines

These Guidelines are intended to provide candidates with information about the processing of candidate-related data. Kirby may amend these guidelines from time to time, should it become necessary to do so. Kirby respects the privacy rights in interest of its candidates and the following principles will be applied when dealing with information that relates to identified or unidentifiable candidates. This type of information will be referred to as "Candidate Data".

Candidate Privacy Principles

  • Data will be collected for the purposes specified below and used accordingly.
  • Data will be as accurate as possible and, where necessary, kept up to date.
  • Data will not be kept longer than is proper or necessary for the purpose for which it is being processed by federal, state or local legal requirements.
  • Data will be collected, used and retained in accordance with the legal rights of the data subject.
  • Appropriate technical and physical measures will be taken to prevent unauthorized access, action or loss, destruction or damage to data, any unauthorized organization, disclosure or processing.

Processing:

1. Kirby processes Candidate data fairly and lawfully for the purposes of an applicant's potential employment. 2. Processing for these purposes include obtaining, recording, holding, adapting, amending, using, limiting, disclosure by transmission, dissemination or otherwise making available data. This includes but is not limited to candidate status, work history, job data, education, compensation, and employer feedback. This list is not exclusive and may be changed and/or added to from time to time.

Information Collection

Subject to federal, state and local legal requirements, Kirby may use external services to collect, process and/or validate candidate data. Kirby requires that such external service will ensure adequate protection for candidate data and comply with federal, state and local legal requirements. It may be necessary to process and transfer Candidate Data within Kirby for consideration purposes. Kirby may be obligated to disclose certain Candidate Data to third parties such as government authorities, to supplier or contract organizations which require the use and/or creation of Candidate Data and it may be necessary to disclose data to protect legal interests and other rights of Kirby, subject to local legal requirements. Kirby undertakes its best efforts to ensure adequate security for sensitive personal data, which includes demographic data, such as your sex, race, ethnicity, color or national origin, religion, and criminal proceedings, and medical data, or personal financial data.
